Instructions for Membership and Affiliation with the Jordanian Arbitrators Association for the year 2025
Issued pursuant to Article (5/e) of the bylaws of the Jordanian Arbitrators Association and its amendments.
These instructions are called "Instructions for Affiliation and Membership in the Jordanian Arbitrators Association for the year 2025".
The following words and phrases, wherever they appear in these instructions, shall have the meanings assigned to them below, unless the context indicates otherwise:
• The Association: The Jordanian Arbitrators Association.
• The Minister: The Minister of the Interior.
• The Board: The Board of Directors of the Association.
• The Chairman: The Chairman of the Board.
• The General Assembly: The General Assembly of the Association.
• The Law: The applicable Jordanian Arbitration Law.
• The Bylaws: The Bylaws of the Jordanian Arbitrators Association and its amendments.
• The Instructions: The Instructions for Membership and Affiliation with the Jordanian Arbitrators Association for the year 2025 and its amendments.
• The Person: A natural person.
• The Application: The official form approved by the Jordanian Arbitrators Association for the purpose of membership.
• • Permanent Board Members: These are the Jordanian Engineers Association, the Jordanian Bar Association, the Jordanian Construction Contractors Association, and the Amman Chamber of Commerce.
• Member: Any person who has joined the association and is listed in its register as an arbitrator.
• Expert: Any person who has joined the association and is listed in its register as an expert.
• Arbitrator: Any person listed in the association's register in this capacity to arbitrate contractual or non-contractual disputes.
The registration application must be submitted on the form prepared for this purpose – attached to these instructions – accompanied by all supporting documents and a declaration of the accuracy of the information provided by the applicant.
Any natural person may apply for membership in the Association as an arbitrator and/or expert, subject to the following conditions:
First: General Conditions
A. The following conditions must be met by anyone wishing to join the Association:
1. The applicant must be of Jordanian nationality. However, arbitrators of other nationalities may be registered by a decision of the Board.
2. The applicant must possess the legal capacity stipulated in Article (43) of the Civil Code.
3. The applicant must not have been convicted of a felony or misdemeanor involving moral turpitude or public morals, nor have been previously declared bankrupt or subject to a disciplinary ruling involving moral turpitude or professional misconduct by any authority, even if their civil rights have been restored.
4. The applicant must be of good character and conduct, and their integrity must be attested to by at least two members of the Board or the Bar Association to which they belong.
5. The application for membership must be submitted according to the form prepared and approved by the Board of Directors, accompanied by copies of all supporting documents and a declaration confirming the accuracy of the information provided in the application. 6. The applicant must be knowledgeable in arbitration matters and the Jordanian Arbitration Law.
7. The Board of Directors and/or the Membership Committee may request an interview with the applicant.
B. The Board of Directors shall issue a decision approving registration with the approval of a majority of its members. However, if the application is rejected, the decision must be justified. The applicant has the right to appeal the rejection decision to the competent minister within (30) days of being notified of the decision. The competent minister, after verification, may take whatever action he deems appropriate, and the decision in this regard shall be final.
C. The applicant must pay the membership fees within thirty days of being notified of the acceptance of his application; otherwise, he shall be considered to have withdrawn the application.
D. The applicant shall become a registered arbitrator in the Association from the date of payment of the membership fees.
Second: Special Conditions Related to the Lists of Arbitrators Maintained by the Jordanian Arbitrators Association:
The following conditions must be met by anyone applying for registration on either of the two lists maintained by the Association:
A. First List: List of Arbitrators in Financial and Commercial Cases:
An applicant for registration on this list must meet one of the following conditions, in addition to the general conditions:
1- Be registered with a recognized international, regional, or national arbitration institution and have practiced arbitration in major commercial and financial disputes as a sole arbitrator, a member of an arbitration panel, or as a lawyer, and have issued at least one arbitration award. These institutions include:
a. International Chamber of Commerce (ICC).
b. London Court of International Arbitration (LCIA).
c. American Arbitration Association (AAA).
d. Cairo Regional Centre for International Commercial Arbitration (CRCICA).
e. Arbitration Committee of the Amman Chamber of Commerce.
f. Saudi Center for Commercial Arbitration (SCCA).
g. Dubai International Commercial Arbitration Centre (DIAC).
h. Qatar International Centre for Conciliation and Arbitration (QICCA).
i. Oman Centre for Commercial Arbitration (OCAC).
r. The Bahrain Chamber for Dispute Resolution (BCDR) Arbitration and Mediation Center.
g. The GCC Commercial Arbitration Center (GCCCAC).
h. The Federation of Engineering Organizations in Islamic Countries - Regional Office/Cairo.
i. Any international, regional, or national arbitration center approved by the Council.
2. Must be a lawyer or former judge who has practiced arbitration in at least one commercial and financial dispute case, either as a sole arbitrator or a member of an arbitration panel, and issued a ruling. The Association must be provided with details of the dispute, its value, the parties involved, and the date of the ruling.
3. Must be a lawyer or former judge with at least ten years of practical experience in handling numerous cases and disputes related to financial and commercial matters.
4. Must be a lawyer or former judge who has previously submitted at least two expert reports in financial or commercial arbitration cases. 5. The applicant must be registered with a chamber of commerce or industry, economic and financial association, or professional syndicate, and have practiced arbitration in financial or commercial cases, issuing rulings in a number of major cases, or possess distinguished experience deemed credible by the board and qualifying them to serve as an arbitrator.
6. The applicant must hold a master's or doctoral degree in arbitration and have at least five years of practical experience in their field of specialization.
7. The applicant must hold a bachelor's degree in law or engineering and have served as a secretary or clerk in arbitration proceedings, fully and consistently, in at least four financial, commercial, or engineering cases up to the issuance of a ruling.
8. The applicant must have served as the director of a legal department or as a legal advisor in a governmental or private entity that has financial or commercial arbitration cases.
9. The board of directors and/or the membership committee may request an interview with the applicant if deemed necessary.
B. Second List: List of Arbitrators in Engineering and Construction Contracts:
An applicant for registration on this list must meet at least one of the following conditions, in addition to the general conditions:
1. Be registered with a recognized international, regional, or national arbitration institution and have practiced arbitration in major disputes arising from engineering and construction contracts, either as a sole arbitrator, a member of an arbitration panel, or as a lawyer, and have issued an arbitration award. These institutions include:
a. International Chamber of Commerce (ICC).
b. London Court of International Arbitration (LCIA).
c. American Arbitration Association (AAA).
d. Cairo Regional Centre for International Commercial Arbitration (CRCICA).
e. Arbitration Committee of the Amman Chamber of Commerce.
f. Saudi Center for Commercial Arbitration (SCCA).
g. Dubai International Arbitration Centre (DIAC).
h. Qatar Center for Conciliation and Arbitration (QICCA).
i. Oman Centre for Commercial Arbitration (OCAC).
j. The Gulf Cooperation Council Commercial Arbitration Centre (GCCCAC).
k. The Bahrain Chamber for Dispute Resolution (BCDR) Arbitration and Mediation Centre.
l. The Federation of Engineering Organizations in Islamic Countries – Regional Office/Cairo.
m. Any international, regional, or national arbitration centre approved by the Council.
In addition, the applicant must be a current member of a professional association (engineers, lawyers, and/or contractors) for a period of no less than ten years.
2. The candidate must be an engineer, lawyer, or judge who has practiced arbitration in a number of major cases and disputes related to engineering and construction contracts, either as a sole arbitrator, chairman, or member of an arbitration panel, and has issued a ruling in these cases. The association must be provided with details of the dispute, its parties, its value, and the date of the ruling.
3. The candidate must be an engineer with at least ten years of experience, including extensive and distinguished experience in managing and executing engineering and construction contracts, preparing claims and programs, and possessing knowledge and expertise in the general terms and conditions of tenders and contracts, as well as the laws and regulations governing them.
4. The candidate must be a lawyer with at least ten years of experience who has practiced in a number of major cases involving disputes arising from engineering and construction contracts, representing clients before courts or arbitration panels, or a judge who has presided over a number of cases related to engineering and construction contracts and issued rulings in them. 5. The candidate must be an engineer holding a postgraduate degree specializing in arbitration, with at least five years of practical experience in arbitration and/or the management of engineering and construction contracts, general contract terms, and tenders; or hold a master's or doctoral degree in arbitration with at least five years of practical experience in their field of specialization.
6. The candidate must be registered with a chamber of commerce or industry or a professional association, have practiced arbitration in cases and disputes arising from engineering and construction contracts, and have issued rulings in a number of major cases, or possess distinguished experience deemed by the association's board of directors to qualify them as an arbitrator.
7. The candidate must hold a bachelor's degree in law or engineering and have served as a secretary or clerk in arbitration proceedings, fully and consistently, in at least four financial, commercial, or engineering cases up to the issuance of a ruling.
8. The candidate must have served as the head of a legal department or as a legal advisor in a governmental or private entity with arbitration cases arising from engineering and construction contracts.
9. The Board of Directors and/or the Membership Committee may request an interview with the applicant if they deem it necessary.
The council may register the arbitrator in both the first and second lists together if both conditions are met.
• The Board of Directors of the Association, by virtue of its powers and in the best interests of the Association, may invite any experienced and reputable lawyers or engineers, or former judges, to join the Association as it deems appropriate. The Board shall issue a decision accepting their membership after payment of the prescribed fees.
• The Board of Directors of the Association, by virtue of its powers and in the best interests of the Association, may approve the addition of a new list to the existing membership lists, called the "List of Young Arbitrators" (lawyers or engineers), to enable them to join the Association. The Board shall consider each application independently and issue its decision of acceptance or rejection as it deems appropriate.
1. The applicant must be of Jordanian nationality, although experts of other nationalities may be registered by decision of the Council.
2. The applicant must possess the legal capacity stipulated in Article (43) of the Civil Code.
3. The applicant must be of good character and conduct, meaning they must not have been convicted of a felony or misdemeanor involving moral turpitude or public morals, or subject to a disciplinary ruling involving moral turpitude or professional conduct by any authority.
4. The applicant must submit a registration application according to the form prepared for this purpose, accompanied by all supporting documents and a declaration confirming the accuracy of the information provided in the application.
5. The applicant must be knowledgeable in the fields or disputes related to financial, commercial, and/or structural engineering arbitration cases.
6. The Board of Directors issues a decision approving registration by a majority vote. If a membership application is rejected, the decision must be justified. The applicant has the right to appeal the rejection decision to the relevant minister within (30) days of being notified of the decision. The relevant minister, after verification, may take whatever action he deems appropriate, and the decision in this regard shall be final.
7. The applicant must pay the membership fees within one month of being notified of the acceptance of his application; otherwise, he shall be considered to have withdrawn the application.
8. The applicant's name shall be registered in the Association's Register of Experts after payment of the prescribed fees.
The applicant will be notified of the council's decision of acceptance or rejection by sending a notification to the telephone number or email address provided on their application. It may also be delivered by hand to an authorized person upon their signature as proof of receipt and a statement of authorization.
Subject to the provisions of Article 6 of the bylaws, the following fees shall be levied:
1. Membership fees for arbitrators:
One-time membership fee: 150 Jordanian Dinars.
Annual subscription fee: 150 Jordanian Dinars.
2. Membership fees for experts:
One-time membership fee: 100 Jordanian Dinars.
Annual subscription fee: 100 Jordanian Dinars.
• Death.
• Resignation.
• Loss of membership eligibility.
• Expulsion by a two-thirds majority vote of the board in cases of damage to the association's reputation.
• Failure to pay dues for two consecutive years.
These instructions shall be effective from the date of their approval by the Board of Directors of the Association, and the Board shall decide on any matter not addressed in these instructions.
